Since october 2015, US warships have made 19 intrusion successively into the 12-nautical mile territorial waters of China's islands and reefs in the South China sea to conduct the so-callled freedom of navigation program, in an attempt to stop China from boosting the construction of its own islands and reefs, contain China's development, and ensure the US dominance in the South China sea and the Asia-Pacific region at large by bolstering and supporting relevant claimants in the south China sea, interfering into the affairs relating to the south china sea in association with other extra-regional countries, challenging China's current legal system, and smearing the image of China. On the basis of the analysis on the deficiencies of the innocent passage regime of warships established by the United Nation Convetion on the law of the sea, the operations of the US warships, their motivations and the ngative affects, the authors have proposed some ideas and approaches to salve this problem
